Welcome to KIXO9 Games. These Terms and Conditions (“Terms”) determine your access to and use of the KIXO9 Games website, including all games, features, and services offered through it (collectively, the “Service”), operated by KIXO9 Games. 

By accessing or using the Service, you agree to comply with these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By using KIXO9 Games, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and, where applicable, our Parent’s Notice. We may update these Terms from time to time, as described in Section 12.

2. Description of Service

KIXO9 Games provides free access to a curated library of browser-based games. No purchase is required to access or play the games available on the Service.

3. Streaming License 

In addition to the license granted in Section 2, KIXO9 Games grants you a personal, revocable, non-exclusive, non-transferable license to:

  • Create and publish content using gameplay footage and/or screenshots from games on the Service
  • Publicly display the Service and its games on video streaming and content platforms, including but not limited to YouTube and Twitch

4. Eligibility

There are no age restrictions to play games on KIXO9 Games; however, if you are under the age of 18, you should review these Terms together with a parent or guardian. 

If you are creating an Account, you confirm that the information you provide is accurate and that you have the legal capacity to agree to these Terms, or that a parent or guardian has done so on your behalf where required by law. If we have reason to believe a user doesn’t meet applicable age requirements, we may restrict their access to the Service.

5. User Accounts

5.1 Account Creation and Accuracy

If you choose to create an Account, you agree to provide accurate, complete, and current information, and to keep it updated. If we have reason to believe your information is inaccurate or outdated, we may ask you to correct it and may restrict access until you do.

5.2 Account Security and Responsibility

Your username and password are personal to you and shouldn’t be shared with anyone else without our prior written consent. You’re responsible for all activity that occurs under your Account. If you believe your Account has been compromised, notify us immediately at. We’re not liable for issues resulting from a compromised account that wasn’t promptly reported.

5.3 Account Termination

You may close your Account at any time through the Service. We may also suspend or terminate your Account if we reasonably believe you’ve violated these Terms, transferred your Account to someone else, created legal risk for us or other users, or if we’re unable to verify information you’ve provided despite reasonable efforts. We may also close Accounts that have been inactive for 1 year.

6. Rules of Conduct

6.1 Prohibited Conduct

You agree not to:

  • Cheat, exploit bugs, or use unauthorized third-party software (including bots or automation tools) to interfere with the Service or gain an unfair advantage
  • Share content that is false, misleading, defamatory, harassing, threatening, hateful, or discriminatory
  • Share sexually explicit content
  • Use the Service to exploit or endanger children in any way
  • Share content that infringes anyone else’s rights, including intellectual property rights
  • Introduce viruses, malware, or other harmful code
  • Attempt to reverse-engineer, hack, or disrupt the Service or related servers/networks
  • Mask your identity to evade restrictions (e.g., through proxies or IP masking)
  • Publicly reveal another user’s identity without consent
  • Impersonate KIXO9 Games or any of its staff
  • Interfere with or diminish other users’ enjoyment of the Service
  • Copy, modify, distribute, sell, sublicense, or create derivative works from the Service without our permission
  • Scrape, harvest, or systematically extract data from the Service — including for the purpose of training AI or machine learning models
  • Circumvent any security, anti-cheat, or access-control measures
  • Use the Service to send spam or unsolicited advertising
  • Violate any applicable law

We reserve the right to remove content, restrict access, or terminate accounts of users who violate this section.

6.2 User-Generated Content

If the Service allows you to submit content (such as a username, profile information, or comments), you retain ownership of it, but you grant KIXO9 Games a non-exclusive, worldwide, royalty-free license to use, display, and distribute it as necessary to operate and promote the Service. You’re solely responsible for the content you submit, and it must not violate Section 6.1 or any applicable law. We don’t actively monitor all User Content and make no commitment to do so, but we may remove any content at our discretion, particularly where it violates these Terms.

If you play games with social or multiplayer features, your display name, avatar, scores, and related activity may be visible to other users.

6.3 Feedback

If you share feedback or suggestions with us about the Service, we’re free to use that feedback without any obligation to compensate or credit you, and without it creating any ownership claim on your part.

7. Intellectual Property Rights 

The Service – including its design, branding, logos, and underlying software – is owned by KIXO9 Games or its licensors and is protected by applicable intellectual property laws. Games made available through the Service may be owned or licensed by third-party developers. All rights not expressly granted to you under these Terms are reserved.

You’re granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial entertainment purposes, subject to Section 3 (Streaming License) above regarding content creation. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written permission, except as permitted by applicable law.

Copyright complaints: If you believe content on KIXO9 Games infringes your copyright, please send a written notice to our email address including a description of the copyrighted work, the material you believe infringes it, and your contact information.

8. Third Party Items

Some games on KIXO9 Games may be developed, licensed, or embedded from third-party developers or platforms. KIXO9 Games does not own these games outright and is not responsible for their underlying code, though we make reasonable efforts to curate games that meet our quality and safety standards. Games on the Service may be subject to their own additional terms and conditions; where those terms conflict with these Terms, the game-specific terms apply only to that game.

Updates to the Terms and Conditions

We may update, modify, or discontinue any part of the Service at any time – for technical, legal, or business reasons – without needing your consent.

Termination of Access and Account 

These Terms remain in effect until terminated. We may suspend or terminate your access at any time, particularly if we believe you’ve violated these Terms or created legal risk for us or others. If we become aware of any violation involving child exploitation or abuse, we will remove the relevant content, restrict the account, and report it to the appropriate authorities.
